You “the Client” acknowledge that in instructing Naturally Wild Consultants Ltd. (“Naturally Wild”) to commence the Services described in the fee proposal (the “Services”) you agree to the application of the terms and conditions below (the “Appointment”) to the exclusion of any other terms or conditions that have been proposed by you.
Acceptance of the fee proposal should be provided in writing (verbal acceptance is at Naturally Wild’s discretion). Instruction from a client and/ or agent to proceed with the Services quoted form a legally binding agreement to pay and to the Terms and Conditions below.
Upon verbal or written instruction for Naturally Wild to proceed with the Services, either in part or in full; the Client shall provide invoicing details (including client name and contact information) prior to the commencement of work.
The Client is responsible for arranging all access to land belonging to third parties (unless previously agreed). Where a separate journey is required for the purposes of collecting a key to gain access, Naturally Wild reserves the right to charge for the time and mileage used at the standard rate.
The price as quoted within the fee proposal remains valid for a period of 3 months from the date given on the fee proposal. Following this period, Naturally Wild reserve the right to review the cost and provide an amended fee proposal if required.
In the event that the Client requests a variation to the Services, the Client shall be notified as soon as is reasonably practicable of the impact of such variation on the cost and programme of the Services.
Cancellation of services should be provided in writing by the Client. The Client is liable for any items of the fee proposal completed prior to this date, which are to be invoiced as quoted and should be paid as per the terms outlined below. Cancellation of a site visit at short notice may also result in non-refundable expenses, such as an accommodation booking, and would therefore be invoiced at cost.
Invoicing is usually conducted on a monthly basis, however, Naturally Wild hold the rights to invoice for works immediately upon completion. Incremental invoices would usually be provided should works exceed one month in duration. The right is reserved to request a deposit or advanced payment of fees where the Client has not previously worked with Naturally Wild.
Payment is due within 28 days from the date of the invoice unless previously agreed in writing. Failure to provide payment within the 28-day period may incur, at the discretion of Naturally Wild, Late Fees and Statutory Interest at the current rate as outlined on GOV.uk.
If invoices remain unpaid after an excessive length of time, Naturally Wild reserves the right to retract all reports and documents provided, deeming them void to all parties.
Due to the nature of any work related to the natural environment and ecology; time frames, proposed days and consultancy are subject to natural environmental constraints. Clients will be advised at the earliest opportunity of alterations in work schedules.
Report revisions, meetings, phone calls and liaisons with Local Planning Authorities (LPA’s), Natural England, Architects, planning consultants, statutory bodies or other will be invoiced at a rate of £30.00 per half hour and this additional work will be clearly identified. Any additional mileage to that quoted within the fee proposal is at a rate of 45 pence per mile.
Payment options: Cheques should be made payable to ‘Naturally Wild Consultants Ltd.’ For BACS transfers – Sort code 09-02-22; Account Number 10277533.
